marcAngel is provided by TomorrowGuild LLC (“TomorrowGuild,” “we,” “us,” “our”). This Privacy Policy explains how we collect, use, share, and protect information when you use the marcAngel iOS app and related services (the “Service”).

If you do not agree with this Privacy Policy, do not use the Service.

1) Information We Collect

A) Information you provide

When you use marcAngel, you may provide:

• Conversation content (messages, prompts, and anything you submit)

• Profile inputs (name, goals, priorities, preferences, and other information you choose to share)

• Feedback (including reports, screenshots, or recordings you send to us)

B) Memory and personalization data

marcAngel is designed to personalize your experience using Memory.

• Memory is ON by default.

• When Memory is on, marcAngel may store certain details from your interactions to help personalize future responses (for example: your preferred name, priorities, recurring projects, or response style).

Where Memory is stored: Memory may be stored on your device and in our cloud (for example, to preserve continuity across sessions and/or devices).

C) Device and diagnostic information

We may collect or receive technical data such as device model, iOS version, app version/build, crash logs, and performance diagnostics.

D) Analytics (optional / opt-in)

If you choose to opt in, we collect usage analytics to improve marcAngel (for example: feature usage, onboarding completion, and general interaction patterns). Analytics are optional and are not enabled unless you choose to enable them.

2) How We Use Information

We use information to provide and operate the Service, personalize your experience (including through Memory when enabled), improve quality and reliability, debug issues, protect against abuse, and respond to support requests.

3) How Memory Works and Your Controls

Memory ON (default)

When Memory is ON, marcAngel may save key information from your interactions to improve personalization and continuity.

Memory OFF

When Memory is OFF, marcAngel will not save new Memories going forward.

Clearing Memory

You can delete saved Memories using in-app controls (for example, “Clear Memory” or “Manage Memory”).

Important: Turning Memory off does not automatically delete previously saved Memories; you can clear them separately.

4) AI Processing and Third-Party Model Providers

marcAngel does not send your conversation content to third-party LLM/model providers for processing. We may still use standard infrastructure providers (e.g., hosting, storage, monitoring) to operate the Service.

5) How We Share Information

We do not sell your personal information.

A) Service providers

We may share information with vendors that help us run the Service (for example: cloud hosting, data storage, crash reporting, and analytics if you opt in). These providers are authorized to use information only to provide services to us.

B) Legal, safety, and security

We may disclose information if we believe it is reasonably necessary to comply with law, protect safety and security, or prevent abuse and fraud.

C) Business transfers

If marcAngel is involved in a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of that transaction.

6) Data Retention

We retain information only as long as reasonably necessary to provide the Service, maintain Memories until you delete them, comply with legal obligations, and improve stability and security. Crash logs and diagnostics may be retained for a limited period.

7) Security

We use reasonable safeguards designed to protect information. No system is completely secure, and we cannot guarantee absolute security.

8) Your Rights and Choices

Depending on your location, you may have rights to request access to, correction of, or deletion of your personal information. You can also turn Memory on/off, clear saved Memories, and opt in/out of analytics (if offered).

9) Children

marcAngel is not intended for children under 13 (or the minimum age required by your jurisdiction). We do not knowingly collect personal information from children.

10) International Users

If you access the Service from outside the United States, your information may be processed in the United States or other locations where our service providers operate.

11) Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will update the “Last updated” date and may provide additional notice if changes are material.

These Terms of Use (“Terms”) govern your access to and use of the marcAngel iOS app and related services (the “Service”), provided by TomorrowGuild LLC (“TomorrowGuild,” “we,” “us,” “our”). By using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1) The Service

marcAngel is a personal AI companion designed to help with planning, writing, brainstorming, and other productivity and creative tasks. The Service may change over time, and features may be added, modified, or removed.

Beta notice: The Service may be offered as a beta or pre-release. It may contain bugs or errors and may not function as intended.

2) Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3) No Professional Advice

marcAngel may generate information that could be interpreted as guidance. The Service is provided for general informational purposes only and is not professional advice.

You are responsible for decisions you make based on the Service. Do not rely on marcAngel for medical, legal, financial, or safety-critical decisions without qualified professional review.

4) Your Content and Responsibilities

A) Your content

You may submit text, prompts, files, or other content (“User Content”). You are responsible for the accuracy and legality of your User Content, ensuring you have rights to submit it, and how you use outputs generated by the Service.

B) Acceptable use

You agree not to misuse the Service, including by violating applicable laws; attempting to access or probe systems without authorization; interfering with the Service’s operation; or using the Service to develop or distribute malware, spam, or abusive content.

We may suspend or terminate access if we reasonably believe you have violated these Terms or pose a risk to the Service or others.

5) AI Outputs and Accuracy

The Service may produce outputs that are incomplete, inaccurate, or inappropriate. You agree to evaluate outputs before relying on them.

You are solely responsible for verifying outputs, how you share or publish outputs, and ensuring outputs comply with applicable laws and third-party rights.

6) Memory, Personalization, and Settings

marcAngel uses Memory to personalize your experience. Memory is ON by default, and you can turn it off in Settings. You can also manage or clear saved Memories.

7) Feedback

If you provide feedback, suggestions, or ideas (“Feedback”), you grant TomorrowGuild a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use and incorporate Feedback into the Service without compensation or obligation to you.

8) Intellectual Property

The Service, including software, design, and trademarks, is owned by TomorrowGuild or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless permitted by law or by our written permission.

9) Third-Party Services

The Service may interoperate with third-party services or content. We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.

10) Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if necessary to protect the Service, users, or our rights.

Upon termination, your right to use the Service stops.

11) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMORROWGUILD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOMORROWGUILD WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT WILL TOMORROWGUILD’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TOMORROWGUILD FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

(Some jurisdictions do not allow certain limitations; in that case, these limits apply to the maximum extent permitted.)

13) Indemnification

You agree to defend, indemnify, and hold harmless TomorrowGuild from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Service, (b) your User Content, or (c) your violation of these Terms.

14) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice in the app or on our website. Your continued use of the Service after changes become effective means you accept the updated Terms.

15) Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules.

17) App Store Terms

If you downloaded the app from Apple’s App Store, you also agree to Apple’s applicable terms and acknowledge that Apple is not responsible for the Service.
